2. Description of Service
CoinHarvest provides automated cryptocurrency tax-loss harvesting services. The Service connects to your cryptocurrency exchange accounts and, when authorized, executes trades to harvest tax losses while maintaining your market exposure.
3. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use this Service. By using CoinHarvest, you represent that you meet these requirements and that you are not prohibited from using the Service under applicable laws.
4. Account Responsibilities
- You are responsible for maintaining the security of your account credentials
- You must enable two-factor authentication before using live trading features
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized access
- You are responsible for the accuracy of exchange API keys you provide
5. Trading Authorization
By connecting an exchange account and enabling live trading mode, you authorize CoinHarvest to execute buy and sell orders on your behalf for tax-loss harvesting purposes. You understand that:
- Trades are executed automatically based on your configured thresholds
- You can disable live trading at any time through your settings
- All trades are logged and visible in your dashboard
- You retain full control over your exchange accounts
6. Not Financial or Tax Advice
Important: CoinHarvest is not a registered investment advisor, broker-dealer, or tax professional. The Service does not provide financial, investment, or tax advice. Tax-loss harvesting involves selling assets at a loss, which may have tax implications. You should consult with a qualified tax professional before using this Service.
7. Risks
You acknowledge and accept the following risks:
- Market Risk: Cryptocurrency prices are highly volatile
- Execution Risk: Trades may not execute at expected prices
- Technical Risk: System failures or exchange outages may occur
- Regulatory Risk: Tax laws and regulations may change
- API Risk: Exchange API changes may affect service functionality
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COINHARVEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold harmless CoinHarvest and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
10. Service Modifications
We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes.
11. Termination
You may terminate your account at any time by disconnecting all exchanges and contacting us. We may terminate or suspend your access to the Service for violation of these Terms or for any other reason at our discretion.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
